Golf Cart Rental Liability Waiver for Buncombe Creek Marina and Resort
Acknowledgment of Risks:
The undersigned (“Renter”) acknowledges that the operation of golf carts involves risks and dangers, including but not limited to the risk of physical injury or death from collisions, overturning, and other incidents or accidents associated with the use of the golf cart. Renter acknowledges these risks and asserts that they are voluntarily participating in these activities and using the equipment with knowledge of the risks involved.
Acceptance of Responsibility:
Renter agrees to be solely responsible for any and all damages or injuries that may occur while operating or in possession of the rented golf cart. This includes responsibility for the operation of the golf cart within the guidelines and rules set forth by CAM Marina, LLC and Buncombe Creek Marina and Resort.
Waiver and Release of Liability:
In consideration of being permitted to rent and operate the golf cart, Renter hereby waives, releases, and discharges CAM Marina, LLC, Buncombe Creek Marina and Resort, its owners, agents, employees, and officers from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Renter or any property belonging to Renter while participating in such activity or while in possession of the rented golf cart, whether caused by the negligence of the releasees or otherwise.
Indemnification:
Renter agrees to indemnify and hold harmless CAM Marina, LLC and Buncombe Creek Marina and Resort against any and all losses, liabilities, damages, expenses, and costs (including attorney’s fees) incurred as a result of any claims, suits, or proceedings brought against CAM Marina, LLC or Buncombe Creek Marina and Resort related to Renter’s use of the golf cart.
Late Fee:
Renter agrees to return the rented golf cart by the agreed-upon time. If the golf cart is not returned on time, Renter will be charged a late fee of $50.
Acknowledgment of Understanding:
Renter has read this waiver and release of liability and fully understands its terms. Renter acknowledges that they are giving up substantial rights, including the right to sue. Renter acknowledges that they are signing the agreement freely and voluntarily, and intend by their signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
Driver’s License Requirement and Agreement Confirmation:
By uploading a copy of your valid driver’s license and completing this form, you affirm that all information provided is accurate and true.
